Terms of Use

Last updated October 13, 2026

These terms apply when you use https://powerwerx.com/ or buy from Powerwerx ("we", "us"). By using the site, creating an account or placing an order, you agree to them. If you don't agree, please don't use the site.

1. Who can buy

You must be at least 18 to create an account or place an order. If you're younger, a parent or guardian must place the order for you. Our site is not meant for children under 13.

2. Your account

Give us accurate information and keep it up to date. Keep your password private; you're responsible for what happens in your account. We may suspend or close an account that breaks these terms or is used for fraud.

3. Products and prices

  • We work hard to describe and picture our products accurately, but mistakes happen. Colors and details may look different on your screen.
  • Prices and availability can change at any time. If a product is listed at the wrong price, we may cancel the order, even after you get a confirmation, and refund anything you paid.
  • Some radios need an FCC license to transmit, such as amateur and GMRS radios. You are responsible for holding any license you need and for using our products legally.
  • Our products are subject to U.S. export laws. You agree not to export or resend them in violation of those laws, including to sanctioned countries or people.

4. Orders

Your order is an offer to buy. Our order confirmation email means we received it; we accept your order when we ship it. We may refuse or cancel any order or limit quantities, including orders that look fraudulent or appear to be for resale. Purchase orders and credit terms for business customers need our approval first.

5. Payment

  • We accept the payment methods shown at checkout. Prices are in U.S. dollars. We add sales tax where the law requires it.
  • You authorize us to charge your payment method for your order, including shipping and tax.
  • When you pay by card, our payment processor gives us a token in place of your card number. By paying by card, you allow us to keep that token to finish your order, charge for items that ship later, issue refunds and, if you have an account, let you use the card again. You can remove saved cards in My Account. Our Privacy Policy explains how we protect your card.

6. Shipping, returns and warranties

Our Shipping page covers delivery options and costs. Our Return Policy covers returns, refunds and warranty claims. Many products come with a manufacturer's warranty. Nothing in these terms limits a product warranty or any right the law gives you that can't be waived.

7. Using our site

Please don't:

  • Break the law, or use our site to defraud anyone, including by testing stolen or unauthorized payment cards.
  • Use another person's account, identity or payment details.
  • Use bots, scrapers or other automated tools on our site without our written permission. Normal search engines are fine.
  • Try to get around our security, overload the site, or upload viruses or other harmful code.
  • Copy our site's code or content, except as section 9 allows.

8. Reviews and other content you send us

Reviews should be honest and based on your own experience with the product. Don't post anything illegal, abusive or hateful, other people's personal information, or ads. If we paid you or gave you a product for your review, say so. We post reviews whether they are positive or negative, and we may remove reviews that break these rules.

You keep ownership of what you post, but you give us permission to display, copy and share it, with your display name, in connection with our business. If you send us ideas or suggestions, we may use them without paying you.

9. Our content

The text, photos, graphics, logos and videos on our site belong to Powerwerx or our suppliers and are protected by copyright and trademark law. You may view and print pages for your own shopping. To use our product photos or other content anywhere else, contact us for written permission first; we may ask you to credit us with a link. Other brand names and logos on our site belong to their owners.

Our site links to other websites, such as manufacturers' sites. We don't control them and aren't responsible for their content or practices.

11. Our site is provided "as is"

We try to keep our site accurate and available, but we can't promise it will always be error-free, secure or online. To the extent the law allows, we provide the site and its content "as is", without warranties of any kind. This doesn't affect product warranties or your rights under the law.

12. Limits on our liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, related to our site or your purchases. Our total liability for any claim is limited to the amount you paid us for the order the claim is about, or $100 if the claim isn't about an order. These limits don't apply to fraud, to injury caused by our negligence, or where the law doesn't allow them. Some states don't allow some of these limits, so they may not apply to you.

13. If you cause a claim against us

If someone makes a claim against us because you broke these terms or the law, or because of content you posted, you agree to cover our reasonable costs, including attorneys' fees.

14. Resolving disputes

Talk to us first. Most problems can be solved by contacting us. Before starting arbitration, either of us must send the other a written notice describing the problem and what is wanted, and give the other 60 days to resolve it.

Arbitration. If we can't resolve it, you and we agree that any dispute about our site, a purchase or these terms will be decided by binding arbitration, except as listed below. The American Arbitration Association (AAA) runs the arbitration under its Consumer Arbitration Rules (adr.org). The arbitrator can award you the same individual relief a court could. Hearings can be by video, phone or written submissions, or in person in the county where you live. If you start an arbitration, you pay no more than the AAA's consumer filing fee and we pay the rest of the AAA and arbitrator fees, unless the arbitrator finds your claim frivolous. If 25 or more similar claims are filed by the same or coordinated lawyers, the AAA's mass arbitration rules apply.

Exceptions. Either of us may bring an individual case in small claims court instead. Either of us may go to court over intellectual property rights. You may always report a problem to a government agency.

No class actions or jury trials. Disputes will be handled only on an individual basis, not as a class, collective or representative action, and an arbitrator may not combine more than one person's claims. You and we each give up the right to a jury trial. If you ask for public injunctive relief (an order that mainly benefits the public), a court will decide that request after the arbitration of your individual claims is finished. If a court decides this paragraph can't be enforced for a claim, that claim goes to court instead of arbitration.

Opting out. You can opt out of arbitration by telling us within 30 days after you first agree to these terms. Send your name, email address and a statement that you opt out of arbitration through our contact form or by mail to the address below. Opting out doesn't affect the rest of these terms.

Courts. Any dispute that goes to court, other than in small claims court, will be heard in the state or federal courts in Orange County, California.

15. Governing law

The Federal Arbitration Act governs section 14. Otherwise, California law governs these terms, except where the law of the state where you live gives you protections that can't be waived.

16. Changes to these terms

We may update these terms by posting a new version here with a new date. The terms posted when you place an order apply to that order. A change to section 14 won't apply to a dispute we already knew about.

17. Other important terms

You agree that we may send you notices and records electronically, by email or on our site, and that they count as "in writing". These terms, together with the policies they link to, are the whole agreement between you and us about using our site. If part of these terms can't be enforced, the rest still applies. If we don't enforce a term right away, we can still enforce it later. We aren't responsible for delays caused by events outside our control.
